Eliseo DeLeon Tye waived his right to a timely preliminary hearing in court Thursday, to allow defense attorney Catherine Mabbuff more time to prepare.
DeLeon Tye was charged with attempted first-degree murder and burglary with the intent to commit murder April 7, after allegedly stabbing his ex-wife, Shelby DeLeon, 14 times in her Moscow apartment.
Mabbuff said she had just recently started to receive reports, so she was not able to suitably prep for the hearing.
Judge John Judge granted DeLeon Tye the waiver and rescheduled the preliminary hearing at 10 a.m. May 11.
District Attorney William Thompson Jr. also asked Judge for the continuance of a no-contact order between DeLeon Tye and DeLeon, which he granted.
DeLeon Tye will remain in the custody of the Latah County Jail.
